Commercial Loans in West Palm Beach, FL: Downtown Zoning, Taxes and What Lenders Check
Short answer
A West Palm Beach commercial loan is sized on the building's income and value, and local taxes move the numbers most: about 20.40 mills in 2026 proposed rates for a city address, plus a Downtown Development Authority levy inside downtown, with a reset to market value the year after you buy. Zoning under the Downtown Master Plan or the city code, a Certificate of Use in your name and flood insurance near the water also reach the term sheet. Commercial and multifamily (5+ units) loans are business-purpose loans, subject to credit approval and property review.
The underwriting basics, and what is local
How commercial lenders use net operating income (NOI), debt service coverage (DSCR) and loan-to-value (LTV) is in our Florida commercial loan guide. In one line: the loan is the smaller of what the building's income can carry and what its value supports.
West Palm Beach adds four items that reach the term sheet: whether the parcel sits inside the downtown districts and their special levy, what the zoning allows, how Palm Beach County will tax the building after you buy it, and flood risk along the Intracoastal and canals.
Property types we see most: downtown retail and mixed-use, small office buildings, warehouse and flex space, and apartment buildings. Five or more units is a commercial loan even with no storefront; see multifamily loans.
These are business-purpose loans. Federal Regulation Z (12 CFR 1026.3) exempts credit made primarily for a business or commercial purpose, so you get a term sheet and commitment letter, not the consumer Loan Estimate. Read the prepayment terms, balloon date and personal guarantee closely.
Downtown: the Master Plan and the DDA levy
Downtown parcels follow the city's Downtown Master Plan (DMP), which regulates about 767 acres. Per the city, as of November 2026:
- What it controls. The 2009 update set districts and subdistricts, street classifications and building envelope rules with a maximum development capacity for each parcel. Downtown has grown from about 1,000 homes and 8 million square feet of nonresidential space under the 1995 plan to over 9,000 homes and more than 10.4 million square feet today.
- An update is in progress. The city released draft zoning regulations on September 9, 2026, held Planning Board presentations on September 15 and October 20, and scheduled a City Commission public hearing for October 26, 2026. If your plan depends on height, density or use, confirm which rules apply to your parcel at closing.
- The DDA levy. The West Palm Beach Downtown Development Authority is a special taxing district created by the Legislature in 1967. Properties inside it pay an extra millage that funds downtown cleaning, landscaping, marketing and façade and leasehold grants. The DDA says its intended rate is 0.9700 mill; its 2026 TRIM notice shows a not-to-exceed 2.0000 mills. Use the higher number until the final rate is set.
Downtown applications such as Special Review (DMP) and Site Plan Review go through the Planning Division (561.822.1461). Fees come from the city's fee estimator, and a second resubmittal after review comments costs 20% of the original application fee. If you plan to change the use or add space, treat the approval as part of the business plan; a bridge loan can fund the purchase and work, with a long-term loan once the new use is approved and leased.
Property taxes: millage, the reset and the 10% cap
Taxes sit inside the NOI your lender uses. The Palm Beach County Property Appraiser lists these 2026 proposed rates for a West Palm Beach address, as of November 2026: city 8.1308 plus 0.0533 debt, county 4.5000 plus 0.0210 debt, school board 6.2870 (state 3.0390 and local 3.2480), Children's Services 0.4908, Health Care District 0.6561, South Florida Water Management District 0.2301 and Florida Inland Navigation District 0.0270. That totals 20.3961 mills outside the DDA, about 2.04% of taxable value. Inside the DDA, add 0.9700 to 2.0000.
- Reset when you buy. Under Florida Statutes 193.1555, commercial property and apartment buildings of 10 or more units are assessed at full just value on January 1 after a change of ownership or control. Buildings of 5 to 9 units fall under 193.1554, which resets the same way.
- Entity sales count. A cumulative transfer of more than 50% of the company that owns the building is a change of control. Buying the LLC does not avoid the reset.
- 10% cap after that. Assessed value for non-school levies cannot rise more than 10% a year. School levies are not capped.
- Big renovations reset it. An improvement that raises just value by at least 25% puts the property back at just value.
City paperwork and flood risk
Business tax receipt and Certificate of Use. Every business in the city needs a business tax receipt for the fiscal year October 1 to September 30; rental property, residential or commercial, uses the city's Rental Tax Application. Rentals also need a Certificate of Use (COU): $50 the first year, $20 a year after, and the city says a COU cannot be exempted. As of November 2026:
- COUs are not transferable. As a new owner, you apply in your own name after closing.
- Apartment buildings: $33.08 per unit, a $20 zoning review for multiple units, a one-time $25 code inspection and a one-time fire inspection for 3 or more units under one roof ($35 for 3 to 11 units, $55 for 12 to 24, $75 for 25 to 100, $125 over 100).
- Owners outside Palm Beach County must name a local agent (City Code Sec. 22-31).
- Renewals run July 1 to September 30; unpaid taxes are delinquent October 1. Questions: 561-805-6700.
Flood. New FEMA maps took effect December 20, 2024 and changed the zone for more than 1,000 West Palm Beach properties. In high-risk A and V zones, flood insurance is mandatory on federally backed loans, and commercial lenders usually require it as a loan condition too. Pull the zone and a real quote before you finalize the NOI; see what a flood zone means for your loan.
Example only: a $2,500,000 West Palm Beach building
Example only, not a quote or an approval. An investor buys a mixed-use building for $2,500,000. The rent roll shows NOI of $175,000 a year after vacancy, taxes on the new price, insurance and expenses. Assume a lender with a 1.25 minimum DSCR and a 70% maximum LTV; each lender sets its own limits by property type.
- Income test: $175,000 / 1.25 = $140,000 a year, the most annual principal and interest the building can carry. The lender turns that into a loan amount using that day's rate and amortization. Rates vary daily; call for today's pricing.
- Value test: 70% of $2,500,000 = $1,750,000.
- The loan is the lower of the two. If the income test supports only $1,600,000, that is the loan, and the down payment grows to $900,000.
Taxes on the new price: at 20.3961 mills, about $50,990 a year outside the DDA. Downtown at the DDA's intended 0.9700 mill, about $53,415; at the 2.0000 cap, about $55,990. That gap is $5,000 of NOI, so know which side of the boundary you are on.
Florida closing taxes on a $1,600,000 loan, as of November 2026:
- Deed stamps: $0.70 per $100 of price outside Miami-Dade = $17,500. Any party can be liable; the contract sets who pays.
- Note stamps: $0.35 per $100 = $5,600. The $2,450 cap applies only to unsecured notes.
- Intangible tax: 2 mills on the loan = $3,200.
