What Is the 3-Day Waiting Period for Mortgages?
Short answer
The 3-day waiting period is the federal rule that you must receive your Closing Disclosure at least 3 business days before you sign the loan (CFPB, as of October 2026). Only three changes restart it: the APR becomes inaccurate, the loan product changes, or a prepayment penalty is added. On a refinance of your primary home, a separate 3-day right of rescission starts after you sign.
Definition
The minimum time between receiving the Closing Disclosure and consummation, set by Regulation Z 1026.19(f). Business days here are all days except Sundays and federal holidays.
Worked example
Example only: you refinance your primary home and receive the Closing Disclosure on Tuesday, December 1, 2026, so you can sign Friday, December 4. On Thursday you switch from a fixed rate to an ARM. That is a product change, so a new CD is issued and the earliest signing becomes Monday, December 7. Rescission then runs Tuesday through Thursday, and the loan can fund Friday, December 11. A change only to a title fee would not have moved the date.
The full timeline
The 3-day CD rule is the last of several federal clocks under TRID (CFPB, as of October 2026):
- Day 0 to 3: the Loan Estimate is delivered or mailed by the third business day after your application. If mailed, it is considered received 3 business days later.
- 7-business-day rule: the Loan Estimate must go out no later than the seventh business day before consummation, so you cannot apply and close the same week.
- 3 business days before signing: you must receive the Closing Disclosure.
- Refinance only: the 3-day right of rescission after signing.
What restarts the clock, and what does not
Per the CFPB's TRID FAQs, a corrected CD must be received 3 business days before signing again only if:
- The APR becomes inaccurate beyond the allowed tolerance
- The loan product changes, for example fixed to ARM
- A prepayment penalty is added
For any other change, such as a fee, a seller credit or the cash to close, it is enough to receive the corrected CD at or before signing. You can waive the wait only for a bona fide personal financial emergency, in a dated, signed written statement; lenders may not use pre-printed waiver forms.
The separate right of rescission on refinances
When a loan puts a lien on your principal dwelling and is not a purchase, Regulation Z 1026.23 gives you until midnight of the third business day after the latest of signing, receiving the Truth in Lending disclosure (usually the CD) and receiving two copies of the rescission notice. Saturdays count; Sundays and federal holidays do not.
- No money is disbursed until the period ends, which is why a refinance funds a few days after signing
- It does not apply to a purchase, and covers only your principal dwelling, not a second home or rental
- To cancel, notify the lender in writing; it must return what you paid within 20 calendar days
In South Florida
In a Miami purchase, the closing date is set in the contract. Lock the rate and settle the product, loan amount and seller credits early, so a last-minute change does not push you past your contract date. Business-purpose investor loans, like DSCR loans to an LLC, are exempt from Regulation Z, so this rule generally does not apply to them.

Questions about 3-Day Waiting Period (TRID Closing Disclosure rule)
Don't see yours? Call us or send a message. We answer the same business day.
305-425-1990Do Saturdays count in the 3-day waiting period?
Yes. For the Closing Disclosure and rescission, business days are all calendar days except Sundays and federal holidays.
Does a lower closing cost restart the 3 days?
No. Fee changes alone do not, unless they make the APR inaccurate. You get the corrected CD at or before signing.
Is there a rescission period when I buy a home?
No. Purchase loans are exempt. Rescission applies to refinances and home equity loans on your principal dwelling.
What if I never got the rescission notice?
If the notice or key disclosures were missing or wrong, the right to rescind may last up to 3 years after closing. The CFPB suggests talking to an attorney.
Can a delay in the CD push my closing?
Yes. If the CD is not received 3 business days ahead, the signing must move. See [clear to close](what-is-clear-to-close) for what has to happen first.
